摘 要：中华人民共和国海事局（原中华人民共和国海上安全监督局）是我国海上交通安全监督和海洋环境保护行政主管机关，他的这一职能是法律所赋予的。《中华人民共和国海上交通安全法》赋予海事主管机关对交通事故的调查处理权力。1984年11月以后，最高人民法院相继在广州、上海等地设立了海事法院，海事法院专门受理海商案件，对海事法院判决和裁定不服的上诉案件，由海事法院所在地高级人民法院管辖。由此产生了对海事行政主管机关调查处理海事权能的争议，2000年7月1日后《中华人民共和国海事诉讼特别程序法》的生效，更使这种争议不断升级。经常看到一些尽陈海事主管机关解决因海事而引起的民事纠纷案件的弊端的文章，提出海事主管机关调查、调解、处理海事的权能应完全由海事法院的司法程序予以替代，本人并不赞成这一观点，但对海事调查、调解、处理现状作客观的总结，进一步作一些探讨，从而推进我们的工作，应该是明智之举，更是“执政为民”的具体体现。
本文先对海事行政主管机关的行政职权、工作性质作了粗浅的介绍，以使从未接触过这一专业性较强的工作的同志对这一工作有所了解。通过围绕海事行政主管机关调查处理海事的合法性、有效性、便捷性，分析海事行政主管机关和海事法院解决海事所引起的民事纠纷案件的利弊，阐述了这一行政职能存在的必要性。同时还指出了海事行政主管机关目前开展这项工作存在的不足，指出其自我完善的紧迫性，并就改进和完善海事行政主管机关海事调查处理现状，提出一些不成熟之个人愚见。

  Abstract: The Peoples Republic of China maritime safety administration(original The Peoples Republic of China maritime harbor administration) is the supervisor organization of our country sea transportation safety direct and sea environment protection,this working talent is given by the law.the November The Peoples Republic of China sea transportation safety law>gives the power of the investigate and handle of maritime affairs to maritime affair supervisor organization.1984 year later,the Supreme Peoples’s Court sets up maritime affairs court in shanghai and Guangzhou...ect. Maritime affairs court specializly accepts sea business case.The case that defys the verdict of the maritime affairs court shoud be ruled over by located high class peoples court. From here produce to maritime affairs administration supervisor organization investigation and handle power dispute, 2000 July 1 later the produce effect of < The Peoples Republic of China maritime affairs litigation special procedure law> turn worse the dispute. Usually see some article that illustrate the irregularity that produce from maritime affairs supervisor organization handle civil dispute case, they bring up that maritime affairs supervisor organization investigation, intermediation, handle the maritime affairs power should be replaced by judicial process of maritime affairs court. I don’t approve this standpoint, but the objective summary and the further make some study of maritime affairs investigation, intermediation, handle present condition can push forward our work ,and it should be a wise measure, be also “ruling for the peoples”.
